Terms of Service for Pomodoro Tab

1. Acceptance of Terms

By installing and using the Pomodoro Tab Chrome and Firefox extension ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Use of the Service

The Service is provided for your personal, non-commercial use only. It is intended to be used as a productivity tool to manage your time using the Pomodoro Technique. You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Service.

3. Permissions

The Service requires the following permissions to function:

  • Notifications: To notify you when a Pomodoro session or break is complete.
  • Side Panel: To display the timer in the browser's side panel for easy access.

4. Data Storage

The Service stores your data locally on your device using your browser's local storage. This includes your todo list, settings preferences, and timer history. We do not store this data on any external servers.

5. Analytics & License Verification

The Service collects anonymous usage data to help us understand how users interact with the extension and improve the product. We use PostHog for analytics. This data includes feature usage events and basic device information (such as browser type and country). We also use FingerprintJS to anonymously identify devices to verify license purchases. No personally identifiable information is collected or shared with third parties.

6. Purchases and Licensing

License purchases are securely processed through DodoPayments. By purchasing a license, you agree to their terms of service regarding payment processing. Your license verification is handled anonymously.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of the creators of Pomodoro Tab. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Your use of the Service is at your sole risk. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

We do not warrant that a) the Service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; or c) the results of using the Service will meet your requirements.

9. Limitation of Liability

In no event shall we, nor our directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Mexico, without regard to its conflict of law provisions.

12. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
